2. Website use

You may use swiftlaborservices.ca for lawful purposes only. You agree not to:

  • Copy, reproduce, or redistribute our content, branding, or code without written permission.
  • Attempt to probe, scan, or compromise site security or availability.
  • Submit false quote requests, fake job applications, or automated form submissions.
  • Use the site to transmit unsolicited marketing, spam, or malicious content.

All content, including copy, imagery, logos, and layout, is owned by Swift or its licensors and is protected by Canadian and international intellectual property law.

3. Quotes and service agreements

A quote issued through this website is an estimate based on the information you provide. Final pricing and terms are confirmed in a written service agreement or work order before a crew is deployed. In the event of a conflict between a quote and a signed agreement, the signed agreement governs.

4. Staffing services

Swift supplies workers on a temporary-staffing basis. Unless expressly agreed in writing, Swift is the employer of record for placed workers. We handle payroll, source deductions, and WorkSafeBC coverage. Clients direct day-to-day work on site and are responsible for workplace safety at their facility under the BC Workers Compensation Act and related regulations.

Clients agree not to solicit, hire, or retain Swift workers directly or through a third party for a period of six months following a worker's last assigned shift, except under a buy-out or conversion term agreed in writing.

5. Pricing, invoicing, and payment

Invoices are issued weekly unless otherwise agreed. Standard payment terms are net 14 from invoice date. Overdue balances accrue interest at 2% per month (26.82% annualized) until paid in full. Swift reserves the right to pause service where accounts are materially overdue.

6. Cancellations and rescheduling

Shifts cancelled with less than 12 hours' notice may be billed at a minimum of four hours per scheduled worker. Multi-day or large-crew cancellations may be subject to the notice terms set out in the service agreement.

7. Compliance

Every Swift worker is WHMIS 2015-trained before their first shift. Role-specific training (HACCP, GPP, PPE, chemical handling) stacks on top where relevant. Clients must provide site-specific orientation, access to required PPE, and any additional training required by the facility's licence or regulator.

8. Warranty disclaimer

Our services are provided on a commercially reasonable-efforts basis. Except as set out in a signed service agreement, Swift makes no other express or implied warranties, including warranties of merchantability, fitness for a particular purpose, or non-infringement.

9. Limitation of liability

To the maximum extent permitted by law, Swift's aggregate liability to any client arising from or related to our services, whether in contract, tort, or otherwise, is limited to the fees paid by that client to Swift in the 90 days preceding the event giving rise to the claim. Swift is not liable for indirect, incidental, consequential, or punitive damages, including lost profits or production downtime.

10. Indemnity

You agree to indemnify and hold Swift, its directors, officers, and employees harmless from any third-party claim arising from (a) your breach of these terms, (b) your negligent or unlawful acts on your premises, or (c) any failure to provide a workplace that meets applicable BC occupational health and safety standards.

11. Third-party links

Our site may link to third-party websites, such as social platforms, regulators, or training providers. Swift is not responsible for the content or practices of those sites. Visiting them is at your own risk and subject to their own terms.

12. Termination

We may suspend or terminate your access to the site and our services if you materially breach these terms or if continued service would expose Swift to legal or safety risk. Sections that by their nature should survive termination (including sections 8 through 14) will survive.

13. Governing law

These terms are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable therein. Any dispute arising from these terms or our services is subject to the exclusive jurisdiction of the courts located in British Columbia.

14. Changes to these terms

We may update these terms from time to time. The "Last updated" date at the top of this page reflects the latest revision. Material changes will be announced on our home page for at least 30 days. Continued use of the site after changes take effect means you accept the updated terms.
